Increasingly used more frequently to reach resolutions on disputes arising in commercial relations, especially in private obligation relations and more so on international platform, the venue of arbitration consists of resolutions made by one or more arbitrators determined without any official qualification on the legal content of the disputes but by free will of the parties on the basis of conditions of arbitration or arbitration agreement, excluding the limitations determined by dictating provisions of law applicable to arbitration.

Arbitration proceedings where the country of origin of both parties is determined as the place of arbitration without any foreign party is defined as domestic arbitration, while arbitration proceedings taking place in a foreign jurisdiction or conducted in accord with judicial laws of a foreign jurisdiction notwithstanding the place of arbitration is defined as foreign arbitration, and arbitration proceedings referred for disputes under contracts in scope of international trade is defined as international commercial arbitration. Leading arbitration institutions around world include ICC, LCIA, AAA, PCA, SCAI, VIAC, SIAC, HKIAC and SCC.
